Hey Reader! Have you ever walked away from a conversation thinking, “That is NOT what I agreed to”? Maybe something wasn’t explained. Maybe what ended up on paper didn’t match what you thought you were signing up for. Maybe someone didn’t follow through. Or maybe you were the one who overlooked something—and now you’re trying to figure out how to make it right. It’s easy to recognize that something went wrong. Understanding what went wrong takes a little more care. And that’s where we’re going this October at Constitution Education. First, a little September housekeeping! After our earlier class together on applying for a state citizen passport, Mark and I are continuing the conversation—this time looking at presentments, especially those coming from agencies like the IRS. If “presentment” is a new word for you, think of the notices, demands, or documents that arrive asking you to respond, pay, or take some other action. What have you actually received? What is being asked of you? And what do you need to comprehend before deciding how to respond? We’re still settling the class title and details, but I wanted you to know it’s coming! September gave us plenty of reasons to slow down, look at the facts, and consider what our words, silence, and conduct communicate. Now we’re ready to take the next step. October: When Things Go Wrong What did the agreement require? Because before we decide what someone else owes us, we need to be willing to examine our own conduct, too. Did I communicate clearly? Did I faithfully do what I agreed to do? Does the writing reflect what we actually intended? Those questions can be uncomfortable. They can also help us see a way forward. And surprise—we’re making this a course, too! The more I work through this material, the more obvious the connection becomes. The Tools of Equity and When Things Go Wrong were made for each other. So October will continue what we began in September, with workbooks, edited teaching videos, and organized modules you can return to as you learn. We’re building something you can sit with, revisit, and work through at your own pace. Sometimes a question becomes clearer the second time you hear it—or when you finally have a real situation to consider alongside it. Here’s what we’ll be exploring together: October 5 — The Promise Beneath Every Agreement We’ll begin with what good reason and good conscience ask of us in our dealings with others. Before we examine a broken agreement, we need to consider the obligations that accompanied it—and whether the problem began when the agreement was made or during its performance. October 12 — Fraud: Intent Isn’t the Only Question “Fraud” is a big word. Before we reach for it, we’ll slow down and examine the facts, the relationship, the duty, and the injury. We’ll explore Gibson’s discussion of actual and constructive fraud, including why a position of trust matters. October 19 — Accident or Mistake: When Equity Will Correct What Went Wrong Sometimes something goes wrong without anyone setting out to cause harm. We’ll explore Gibson’s treatment of accidents and mistakes, the boundaries around correction, and why recognizing a mistake is only the beginning of the inquiry. We meet Mondays at 8 PM Eastern.
